Premier Asserts Devices in Custom Kits Should Not Be Subject to Medical Device Tax

Today, Premier healthcare alliance submitted comments on the issue of medical device taxation. In its comments, Premier argued that devices included in sterile hospital custom procedure trays or kits should not be subject to the tax, and that a specific example to that end should be included in the final IRS rules to underscore this point.

Premier requested that the final rules prevent manufacturers from passing medical device tax costs on to hospitals by certifying that the tax has not been included in the final price.
